Respecting your privacy

We respect your personal information, and this Privacy Policy explains how we handle it. The policy covers Fleurieu Wellbeing Pty Ltd in accordance with the Privacy Act 1988 (Cth). The policy is based upon the 'Guidelines on Privacy in the Private Health Sector', Office of the Australian Information Commissioner and meets regulatory standards.

Privacy and Information Management Policy

Fleurieu Wellbeing Pty Ltd will comply with the following:

•    the Privacy Act 1988 and the Privacy Amendment Act 2012 to protect the privacy of individuals' personal information

This includes having in place systems governing the appropriate collection, use, storage and disclosure of personal information, access to and correction and disposal of that information.

Compliance with legislative requirements governing the privacy of personal information. 

All Fleurieu Wellbeing Pty Ltd participants are satisfied that their personal information is kept private and only used for the intended purpose.

Each participant accesses supports that respect and protect their dignity and right to privacy. 

To achieve this outcome, the following indicators are demonstrated:  

•    Consistent processes and practices are in place that respect and protect the personal privacy and dignity of each participant. 

•    Each participant is advised of confidentiality policies using the language, mode of communication and terms that the participant is most likely to understand. 

•    Each participant understands and agrees to what personal information will be collected and why, including recorded material in audio and/or visual format.

You have access to your own records.

Unless we are obligated under law not to provide you with your records, you may request a copy of the information we hold about you at any time by contacting us directly in writing. We will speak with you directly to ensure you are the person requesting records and then supply you with these as soon as practicable.

What personal information do we collect and hold?

The types of information that we collect and hold about you could include:

• ID information such as your name, postal or email address, telephone numbers, and date of birth;

• financial details such as your method of payment and case notes of services provided

How do we collect your personal information?

Unless it’s unreasonable or impracticable, we will try to collect personal information directly from you (referred to as ‘solicited information’). For this reason, it’s important that you help us to do this and keep your contact details up-to-date.

We may seek information from you in several ways. We might collect your information when you fill out a form, give us a call, or use our website. We also find using electronic means, such as email or SMS, convenient for communicating and verifying your details. However, we’ll never ask you for your security details in this way—if you are ever unsure, contact us.

How do we take care of your personal information?

The security of your personal information is important to us, and we take reasonable steps to protect it from misuse, interference loss and unauthorised access, modification or disclosure. Some of the ways we do this are:

• document storage security policies;

• security measures for access to our systems; and

• only giving access to personal information to a person who is verified to be able to receive that information.

What are the ways we use your information?

• identifying you;

• telling you about products or services we make available and that may be of interest to you unless you tell us not to;

• allowing us to run our business efficiently and perform general administrative tasks;

• preventing any fraud or crime or any suspected fraud or crime;

• as required by law, regulation or codes binding us; and

• any purpose to which you have consented.

Who can we share your personal information with?

We will not share your personal information with any third parties without your written consent. Fleurieu Wellbeing Pty Ltd refers to their privacy policy in the participant’s NDIS Service Agreement.

The Service Agreement includes 4 Consents;

a.    Consent is required to share and obtain information

b.    Consent for receiving services

c.    Consent to participate in Participant Satisfaction Surveys

d.    Consent to participate in Quality Management Activities

The exception is a court-ordered subpoena, where we must, by law, provide the courts with any information we hold if requested.

How do you correct your personal information?

Contact us if you think there is something wrong with the information we hold about you, and we’ll correct it if it’s inaccurate, out of date, incomplete, irrelevant or misleading.

Management of a Privacy Complaint

If a person has a complaint regarding the way in which their personal information is being handled by Fleurieu Wellbeing Pty Ltd, in the first instance, they are to contact the CEO. The complaint will be dealt with as per the Complaints Management Policy. If the parties cannot reach a satisfactory solution through negotiation, the person may request an independent person (such as the Office of the Australian Privacy Commissioner) or the NDIS Quality and Safeguards Commission to investigate the complaint. Fleurieu Wellbeing Pty Ltd will provide every assistance with this process.
